These Terms of Service govern your access to and use of the Oil Painting Haven website and your purchase of products and services from us.
This website is operated by OIL PAINTING HAVEN LTD, trading as Oil Painting Haven.
By using our website or placing an order, you agree to these Terms of Service and to the policies incorporated into them by reference.
Nothing in these Terms excludes or limits any consumer rights or remedies that cannot lawfully be excluded or limited under applicable law.
1. About Oil Painting Haven
Oil Painting Haven sells individually hand-painted oil paintings, including standard catalog paintings, made-to-order paintings, framed and unframed artwork, custom paintings, and artwork for residential and commercial projects.

2. Eligibility and Website Use
You must have the legal capacity to enter into a contract in your jurisdiction in order to place an order with us.
You may not use our website or services for unlawful, fraudulent, abusive, or unauthorized purposes.
You must not introduce malicious software, interfere with website security, attempt unauthorized access, or misuse the website in a manner that could damage Oil Painting Haven, Shopify, other customers, or third parties.
We may restrict access to the website where reasonably necessary to protect the security, integrity, or lawful operation of our services.
3. Hand-Painted Nature of Our Artwork
Every Oil Painting Haven painting is individually hand-painted.
Because of the handmade process, minor differences in brushwork, texture, color, details, and other artistic characteristics may occur between a finished painting and images shown on our website.
Such reasonable artistic variations are part of the handmade nature of the product and do not by themselves mean that an artwork is defective.
This does not affect your rights where an artwork is damaged, defective, incorrect, materially misdescribed, or materially different from the agreed order.
4. Made-to-Order Paintings
Many paintings offered on Oil Painting Haven are produced individually after an order is placed rather than being held as finished inventory.
A standard catalog painting does not become a custom or personalized product solely because it is painted after you place your order.
Typical production time and estimated delivery time are described in our Shipping Policy.
Production times are estimates and can vary according to size, complexity, revision requests, drying requirements, framing, and other reasonable production factors.
5. Completion Photos, Revisions and Final Approval
For made-to-order paintings, we will normally provide photographs of the completed artwork for review before shipment.
We want customers to be satisfied with the finished artwork before shipment. For made-to-order and custom paintings, customers may request reasonable adjustments before giving final approval, and we will continue working with the customer on reasonable revisions within the agreed scope of the order until the artwork is approved for shipment.
Where adjustments are reasonably required, customers should request them before approving the painting for shipment.
Revision requests and final approval directly affect the production and delivery schedule. Each additional revision may require additional painting, drying, inspection, framing, packaging, or preparation time.
A customer may not require Oil Painting Haven to dispatch an artwork by a fixed deadline, or require the artwork to be delivered or received by a fixed date, while the artwork is still undergoing requested revisions or while final approval has not yet been provided.
Any previously estimated production, completion, dispatch, or delivery date may therefore be reasonably adjusted when the customer requests additional revisions, delays providing feedback, or has not yet provided final approval.
Once the customer gives final approval for shipment, we will proceed with the remaining drying, framing, packaging, and dispatch preparations as soon as reasonably possible.
If a customer requires dispatch or delivery by a particular date, that requirement must be communicated and expressly agreed by Oil Painting Haven before the order is confirmed. A requested dispatch, delivery, or receipt date is not guaranteed unless we have expressly accepted it in writing.
Approval of completion photographs does not remove rights relating to damage in transit, defects, incorrect goods, or a material failure to meet agreed specifications.
6. Custom and Personalized Artwork
Custom or personalized artwork may include paintings created from personal photographs, unique customer-supplied compositions, significant requested changes, unusual custom sizes, specifically requested color palettes, or other individual specifications.
Because genuinely customized products are created specifically for an individual customer, different cancellation and return rules may apply.
Details are set out in our Return & Refund Policy and, where applicable, any separately agreed custom-order quotation or agreement.
A separately agreed written quotation or project agreement may contain additional specifications, production milestones, approval requirements, or cancellation terms for that particular order.
7. Customer-Supplied Images and Custom Content
If you provide photographs, images, designs, instructions, or other materials for a custom painting, you are responsible for ensuring that you have the right to provide and use those materials for that purpose.
You grant Oil Painting Haven and the artists or service providers involved in fulfilling your order the limited permission necessary to use those materials solely for producing and fulfilling your requested artwork and related order services.
We do not obtain ownership of your personal photographs merely because you submit them for a custom order.
We will not use identifiable customer-supplied personal images for public marketing or case studies without an appropriate basis or permission.
8. Product Information and Display
We make reasonable efforts to ensure that product descriptions, dimensions, images, pricing, framing options, and other information are accurate.
Colors displayed on a screen may vary according to the customer's device, screen settings, lighting, and the handmade nature of the finished painting.
If a material error is identified in a product listing or order, we may contact you to correct the error and, where appropriate, offer the option to continue with the corrected information or cancel the affected order for a refund.
9. Prices, Shipping Costs, Duties and Taxes
Unless clearly stated otherwise before an order is confirmed, the price payable for an Oil Painting Haven order includes the standard shipping costs and applicable delivery-related taxes, customs duties, and import charges required for normal delivery.
Customers are not normally required to pay additional standard shipping charges, customs duties, or taxes upon delivery.
If an unexpected payment request is made by a carrier or customs authority for an order where these costs have already been included, please contact us before making payment.
Any exceptional commercial or project-specific pricing arrangement will be disclosed or agreed before the relevant order is confirmed.
10. Orders and Order Acceptance
When you place an order, you are offering to purchase the selected products subject to these Terms and the information presented during checkout.
An automated order confirmation confirms that we have received your order but does not prevent us from reviewing the order for payment, pricing, availability, fraud, shipping, legal, or technical issues.
We may refuse or cancel an order where reasonably necessary, including in cases of suspected fraud, unlawful activity, material pricing or listing error, inability to fulfil the order, payment failure, or a material breach of these Terms.
If we cancel an accepted order that has been paid for and the cancellation is not caused by a customer's breach or other lawful deduction, we will refund the amount due in accordance with applicable law.
We will not cancel an accepted order merely because the product price later changes.
11. Payment
Payment methods available at checkout may be provided by Shopify Payments, PayPal, card networks, or other payment providers.
You agree to provide accurate and authorized billing and payment information.
Payment processing may be subject to the terms, fraud controls, verification procedures, and processing rules of the relevant payment provider.
We do not receive or store your complete payment-card credentials where those credentials are processed directly by our payment providers.
12. Shipping and Delivery
Production timelines, standard shipping estimates, ocean freight arrangements, tracking, delivery appointments, duties, taxes, lost shipments, and transportation damage are governed by our Shipping Policy.
In particular, framed paintings with any dimension greater than 38 inches will generally be transported by ocean freight, as described in the Shipping Policy.
Ocean-freight transit time is generally approximately 28–35 days after dispatch.
Once an ocean-freight shipment arrives in the destination country and completes the applicable import and transfer procedures, final delivery will be completed by truck.
The truck driver or local carrier will contact the recipient by telephone in advance to confirm the delivery time.
Delivery dates are estimates unless expressly agreed otherwise in writing.
13. Returns, Refunds and Exchanges
Returns, cancellations, refunds, exchanges, damaged goods, and custom-order return conditions are governed by our Return & Refund Policy.
Eligible standard catalog paintings may be returned within the return period specified in that policy.
Genuinely custom or personalized artwork may be subject to different cancellation and change-of-mind return rules once physical painting production has begun.
Nothing in our Return & Refund Policy or these Terms restricts rights relating to damaged, defective, incorrect, materially misdescribed, or otherwise non-conforming goods where those rights apply by law.
14. Commercial and Trade Orders
Hotels, interior designers, restaurants, offices, hospitality businesses, bulk purchasers, and other business customers may receive separate quotations or project agreements.
Such agreements may specify pricing, deposits, artwork specifications, production milestones, approvals, shipping arrangements, cancellations, and other project-specific terms.
Where separately agreed written commercial terms conflict with these general Terms, the specific commercial terms will apply to that project to the extent permitted by law.
15. Intellectual Property
Unless otherwise stated, the Oil Painting Haven name, branding, website text, graphics, photographs, page designs, logos, and other website content are owned by or licensed to OIL PAINTING HAVEN LTD.
Website content may not be copied, reproduced, republished, distributed, commercially exploited, or used to create misleading representations of Oil Painting Haven without authorization, except where permitted by law.
Purchasing a physical painting does not automatically transfer copyright or other intellectual-property rights in the underlying image or artwork unless such rights are expressly transferred in writing.
16. Third-Party Services and Links
Our website may use or link to third-party services, including Shopify, payment processors, logistics providers, social platforms, and other external websites.
Third-party services may operate under their own terms and privacy policies.
We are not responsible for the independent content, security, availability, or practices of third-party websites that we do not control, except to the extent liability cannot lawfully be excluded.
17. Privacy and Personal Information
Our collection, use, disclosure, and handling of personal information are described in our Privacy Policy.
The former oilpaintingtour.com domain is not used as the governing privacy-policy location for Oil Painting Haven.
18. Accuracy, Errors and Website Changes
We make reasonable efforts to keep information on our website accurate and current, but typographical, technical, pricing, or other errors may occasionally occur.
We may correct errors, update content, or change product information when reasonably necessary.
Where a material change affects an order already placed, we will handle the affected order fairly and in accordance with applicable law rather than automatically applying the change retrospectively.
Product prices and availability may change for future orders without prior notice. Such changes do not by themselves alter the price of an order already accepted.
19. Limitation of Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including any liability or consumer remedy that cannot lawfully be excluded or restricted.
For consumers, our products remain subject to applicable statutory requirements concerning quality, description, conformity, and other mandatory consumer protections.
To the maximum extent permitted by law, we are not responsible for indirect or consequential losses that were not reasonably foreseeable when the contract was entered into and that are not caused by our breach of a legal duty.

If a separately agreed written custom or commercial agreement contains specific terms that conflict with these general Terms, the specific agreed terms will apply to that particular order to the extent permitted by law.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect where legally possible.
